1. Who we are

NicheCut (nichecut.com) is operated by sole proprietor (FOP) Mykhailo Stepanovych Mohish, taxpayer ID 2806903056, Volovets, Zakarpattia Oblast, Ukraine (full postal address on request at [email protected]) ("we", "us"). Contact: [email protected].

By creating an account or using NicheCut you agree to these Terms. If you do not agree, do not use the service.

2. The service

NicheCut analyses a video you point it to, helps you plan an original script, and generates voice-over, frames, animation and an edited video using third-party AI providers.

Generated output can contain mistakes. You are responsible for reviewing it before publishing.

3. Payments and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Purchases give you credits that are spent on generations as shown before each paid action. Prices include or exclude taxes as displayed at checkout by Paddle.

4. Your content and rights

You must own or have permission to use everything you submit: reference links, texts, images, audio and voices. You must not submit material that infringes anyone’s copyright, trademark, privacy or publicity rights.

Reference videos are used only to analyse structure, pacing and style. Do not ask NicheCut to reproduce someone else’s video, narration, characters or artwork.

Subject to these Terms and to the providers’ terms, you own the videos you create with NicheCut and may use them commercially.

5. Acceptable use

You may not use NicheCut to impersonate real people, clone a real person’s voice without their consent, create deceptive, defamatory, hateful, sexual content involving minors, or content that violates YouTube or other platform policies or any law.

You may not attempt to break, overload, scrape or resell the service, or share your account.

6. Availability and changes

We may change, suspend or discontinue features. We aim for high availability but provide the service “as is”, without warranties to the extent permitted by law.

7. Liability

To the extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 3 months before the claim. We are not liable for indirect or consequential losses, lost profits or channel penalties.

8. Termination

You can delete your account at any time. We may suspend accounts that break these Terms. Unused credits of suspended accounts may be forfeited where the suspension results from a breach.

9. Governing law

These Terms are governed by the laws of Ukraine, without prejudice to mandatory consumer protections of your country of residence.
